Summer is the busiest time of year at Košice Airport – and full aircraft inevitably bring delays. The good news is that passengers flying from Košice are protected by EU Regulation 261/2004, which grants the right to care and financial compensation of €250 to €600 in the event of a long delay, cancellation or denied boarding. This guide explains when you are entitled to compensation, how to proceed at the airport and what to watch out for.
When EU Regulation 261/2004 applies to your flight
The regulation covers all flights departing from an airport in the European Union – including every departure from Košice – regardless of whether you fly with a European or non-European carrier. For flights into the EU from a third country (for example returning from Turkey or Egypt), it applies when the flight is operated by an EU-based carrier. It covers both scheduled routes and charter flights sold as part of package holidays.
How much money you can claim for a delay
Financial compensation is due to passengers who reach their destination three hours late or more. The amount depends on the length of the route:
- €250 for flights up to 1,500 km (for example Košice – Prague),
- €400 for intra-EU flights over 1,500 km and other flights between 1,500 and 3,500 km (for example Košice – London),
- €600 for flights outside the EU longer than 3,500 km.
If your departure is delayed by more than five hours, you may abandon the journey entirely and request a refund of your ticket. An important detail: for compensation purposes, what counts is the delay on arrival at your destination, not at departure.
Food, drinks and a hotel: care while you wait
The right to care kicks in earlier than the right to money. The carrier must provide free refreshments and drinks appropriate to the waiting time, plus two phone calls or e-mails, from a delay of two hours (flights up to 1,500 km), three hours (intra-EU flights over 1,500 km and other flights up to 3,500 km) or four hours (longer flights). If your departure is postponed to the next day, you are entitled to a hotel and transport to and from it. If the carrier fails to provide care, keep your receipts – you can claim reasonable expenses back later.
When you will not receive compensation
The carrier does not have to pay compensation if the delay was caused by extraordinary circumstances that could not have been avoided even with all reasonable measures – extreme weather, air traffic control strikes, airspace closures or security risks. According to rulings of the Court of Justice of the EU, an ordinary technical fault is generally not an extraordinary circumstance. And note: the right to care (refreshments and, where needed, a hotel) always applies, even in extraordinary circumstances.
Cancelled flights and denied boarding
If your flight is cancelled, you can choose between a refund and rerouting on the earliest available flight. Compensation of €250 to €600 also applies here, unless the carrier informed you at least 14 days before departure or offered an alternative connection at a similar time. If you are denied boarding because the flight is overbooked, the right to compensation arises immediately.
Connecting flights: the delay is measured at the final destination
Many passengers from Košice travel with a connection via Vienna, Warsaw or London. If your whole journey is on a single booking, the delay is assessed at the final destination. Even if the first flight from Košice is only an hour late, but a missed connection means you arrive more than three hours late, you are entitled to compensation – calculated on the total distance of the whole journey. With two separate bookings, each flight is assessed individually and you bear the risk of a missed connection yourself, so it pays to buy connecting flights on one booking.
One more practical tip: you can file a claim yourself, free of charge. Specialised claim agencies can speed the process up, but they charge a commission on the amount awarded. The carrier’s online form, a copy of your boarding pass and a short description of what happened are usually all you need.
What to do at Košice Airport
First check the current status of your flight in our arrivals and departures overview. Submit your claim directly to the carrier – both Ryanair and Wizz Air have online forms for this.
