A delay of several hours, or an outright cancellation, can seriously disrupt your travel plans – but passengers are not powerless. Regulation (EC) No 261/2004 grants clear rights for flights departing from and arriving at Košice, ranging from care while you wait to financial compensation of up to EUR 600. On top of that, 2026 is set to bring the biggest reform of these rules in the past twenty years, expected to introduce, among other things, a free piece of hand luggage. This article summarises what applies today and what is about to change.
Compensation for a delayed flight from Košice
If your flight arrives at its destination three hours or more behind schedule, you are entitled to financial compensation, provided the delay was caused by the airline and did not result from extraordinary circumstances. The amount of compensation depends on the length of the route:
- EUR 250 for flights up to 1,500 km,
- EUR 400 for flights over 1,500 km within the EU, or for other flights between 1,500 and 3,500 km,
- EUR 600 for flights over 3,500 km.
For passengers travelling from Košice, it is worth knowing that most routes – London, Dublin, Vienna, Warsaw, Bratislava, Rome, Málaga, Zadar, Antalya or Burgas – fall into the shorter and medium distance bands, so in practice compensation of EUR 250 or 400 is more likely than the top amount of EUR 600, which mainly applies to long-haul flights outside Europe. You can check the exact arrival time via current arrivals and departures or the clear flight schedule, which is especially useful when documenting the length of a delay.
Flight cancellation: ticket refund, rerouting or compensation
If your flight is cancelled, you have the right to choose between a full refund of the ticket price (including any unused connecting legs), rerouting on the next available flight, or rerouting to a later date of your choice. If the airline notified you of the cancellation less than 14 days before the scheduled departure and did not arrange a replacement flight with a comparable arrival time, you are also entitled to financial compensation in the same amount as for a delay – that is, EUR 250 to 600 depending on the distance. The right to compensation does not apply, however, if you were informed of the cancellation in good time, or if the replacement flight got you to your destination with only a small time difference compared with the original schedule.
When looking for an alternative connection, it is also worth checking other destinations from Košice or the offer from Ryanair at Košice, which operates the largest number of scheduled routes at the airport.
The right to care while you wait
Regardless of whether you ultimately receive financial compensation, once a delay reaches a certain number of hours you are entitled to free care from the airline. This includes reasonable refreshments and meals appropriate to the waiting time, two phone calls, emails or faxes, and, if an overnight stay or an extension of your originally planned trip becomes necessary, hotel accommodation including transport between the airport and the hotel. These obligations apply regardless of whether the delay was caused by extraordinary circumstances – the airline cannot avoid them even when it was not itself responsible for the cause of the delay.
When no right to compensation arises: extraordinary circumstances
The regulation also provides for an exception that releases the airline from the obligation to pay financial compensation – the so-called extraordinary circumstances. These typically include adverse weather that makes a safe flight impossible, security risks, political instability, strikes beyond the airline’s control, or hidden aircraft defects that could not have been detected through routine maintenance. By contrast, technical problems arising from the normal operation of the aircraft, crew shortages or poor planning by the airline are not considered extraordinary circumstances, and the right to compensation remains in place. If you are not sure whether the exception applies in your case, we recommend checking the official reasons directly with the airline and, if in doubt, submitting your claim in writing – each case is assessed individually.
How to file a claim
You file a claim directly with the airline, usually in writing or via a form on its website. It is useful to keep your boarding pass, booking confirmation and information about the actual departure or arrival time. If the airline rejects your claim or does not respond, you can turn to the Transport Authority of the Slovak Republic (Dopravný úrad), which oversees compliance with the regulation in Slovakia, or use the services of a specialised claims company. The upcoming reform of Regulation 261/2004: what is changing
In June 2026, the European Parliament and the Council of the EU reached a political agreement on the first major reform of the regulation since 2004, and in early July 2026 it was approved by a large majority in the European Parliament’s plenary vote. The legislative process is not yet complete, however – the agreement still needs to be formally confirmed by the Council of the EU and subsequently published in the Official Journal of the EU, with member states and airlines then given a transition period to put the changes into practice. Real-world application of the new rules is therefore not expected before 2027 – until then, the current rules apply exactly as described above.
Among the changes agreed so far, the following are particularly worth noting:
- The 3-hour threshold for compensation stays unchanged – the proposal to extend it to 4–6 hours did not make it into the final agreement, and the amounts of EUR 250, 400 and 600 remain the same.
- Free hand luggage – the base ticket price will have to include one personal item and one bag that fits under the seat in front of you; airlines will still be allowed to charge extra only for larger cabin baggage placed in the overhead lockers.
- Simpler claims process – claims will be able to be filed within nine months of the flight, and the airline will have 30 days to pay out or provide a written justification for rejecting the claim.
- Automatic refunds in the event of a cancelled flight, if the passenger does not take up the replacement connection offered.
- Free seating for a parent next to a child under 14, with no extra charge for seat selection.
As this is still a proposed text that has not yet been formally adopted, we will keep monitoring the exact effective dates and the final wording, and will update this article as the situation develops. Until then, when planning your trip through Košice, it is worth keeping an eye on the current arrivals and departures and on airport parking, so you have a buffer in case of unexpected changes to the flight schedule.
